Hi Folks,

What is the fastest and perhaps a little economic way to get documents over to chennai (Tamil Nadu) or Calicut (Kerala) from here in San Jose, ca.

USPS has this service called Express Mail ($27.95) or Priority Mail ($12.95)
I guess USPS is claiming 6-10 days (guess no gurantee) to india.

Other couriers seems to be $70+ (FedEx, UPS, DHL)..

Anyone has had good luck with USPS ? or do you suggest the couriers mentioned above ?

Need to get docs for an interview for parents on Feb 26th in Chennai...

I had no issues with USPS. Used them thrice to send docs to Chennai. It goes within 7-10 days. They give you a tracking number also, but as one of the other members pointed out, its difficult for you to track it.

Sorry I have no advise as I am filing my AP tomorrow for the first time. However it scares me that it's been over 3 months that USCIS received your application. I am sending out mine tomorrow and need to get it it by late February. Wondering if I should mention in my covering letter about expediting it. I am also planning to include prepaid envelope.

I received a RFE on experience letters (EB3). I have searched everywhere but haven't found the format for a winning experience letter.

Can someone with an approved 140 please paste a format of the experience letter on this thread?

I have e-filed along with spouse new SSN#..no issues...

When we sent cancel letter for ITIN,got a reply confirmation from IRS saying you can now use ssn# for tax filing purposes....

What is the best way to send the documents to the emabassy? I asked because I live in Ahmedabad and I am planning to go for stamping the very next day I arrive in India.

If they receive too many responses during advertizing period, they may not process your gc. That is all to it. At that time u might chill out and wait for a year or so and reply. If your skills are in demand, I do not see a reason to wait. It is always better to take a dive as early as possible. Good luck.

Absolutely correct. This is the experience I had in my case. My company is fortune 550 company. They received lot of responses when they posted ads. I could not beleive the repsonse I got from VP. And they do not want to file green card now. He simply said 'he found candidates' :(

The online system shows the date the case was entered into the system and it doesnt reflect the actual physical receipt date.....Receipt date box on the I-797 receipt notice will be the actual receipt date....For majority of cases, the online case status date is the actual notice date and/or the date the case was entered into the system....

If its I-94# whatever is your latest number, from Actual I-94 card or I-94 attached with the latest H1 renewal/extention

The A# is assigned the first time that you apply for I-485.
It is not the number on I-94. That number is everytime they issue a new one when you enter the US.

I have an unfortunate situation. My parents names are misspelled in the Birth certificate compared to the Passport parents name page. Do we need to submit the parents names page of the passport when we submit our documents for 485 ?? Please let me know if this will be a problem and if there is a work around for this ??

Also if I have a Birth certificate (with my actual full name - dated in 2007 though), do I need to submit the affidavits ??

It would be better to get affidavits from your parents ,if u submit without affidavits u might get a RFE and this might delaying your process.

My wife's I-485 is currently pending. Along with the I-485, an I-131, and I-765application was filed on July 31, 2007. As you know, the process time frame for the I-131 is 90 days. The I-131 was being a bit delayed due to the amount of fillings from the new fee increases. Over 120 days later in mid Dec. I still had not received confirmation.

Unfortunately, I just purchased tickets to travel overseas to visit family and friends for after Christmas. I emailed my immigration lawyer about the status and they only said that it's still pending.

Over a period of a few days my wife and I contacted USCIS to check on the status, and we found out that there was an error on her date of birth. That very day the date of birth was corrected and the I-131 was expedited and we received the documents in time to travel a few days later.

The immigration lawyer says that the error in the date of birth had little to none effect on why the I-131 was delayed. Instead he believes the delay was because he didn't receive tax documents from me till Dec. 4., which he believes is why the I-131 and I-765 was approved on the same day.

However, I asked for a fee reduction due to his lack of service. Due I have a valid argument? Any thoughts welcomed!

A member posted that s/he did labor certification and I-140 on F1. I don't remember the name of the thread.

You can do labor certification without H1 as long as employer is willing.

For MTR - Brief / Evidence need to be given within 30 days of denial.
For Appeal - A brief statement of what the error with the decision or what the new evidence is needed in the form, later actual evidences can be given within 30 days of filing form 290(B).
In either case, 290(B) have to be filed to keep it going.

Both Appeal and MTR should be sent to the service that made unfavorable change and later on when additional evidences are sent they need to be send to AAO directly.

Thank you for the suggestion.....From what I understand from it, the evidence for MTR has to be filed with the MTR and cant be filed later. Is that right? If so, then my only choice is Appeal since my W-2 will not reach me before the due date of the 290B.

My LCA Job title is "Computer and Information Systems Manager" , O-net Job Code 11-3021.00. Can I take a job of "Computer Systems Engineers/Architects" , O-net Job Code 15-1099.02. Is it not considered as similar occupation?

In conservative view, though both are in same field, both are not similar occupation becuse one is "engineer" and other is "manager". Engineer skills and responsibilites and duties are different than manager. So it will not qualify to AC21 portability. For similar occupation classification, both should be in same family in Onet or it should have first 2 numbers in the code should be same.

Nothing make sense here, since USCIS itself preparing for large volume of I485 cases in July. They infact stopped the premium processing effective from July 2nd. So why they have to go back to stone age dates? Moreover, new fee gets effective from July 29 and if anyone files on/after July 29 do not required to shell out AP and EAD renewal fees during endless I-485 approval. If they get everyone filed before july29, then everyone end up with paying AP and EAD renewal fees for next decade. This would generate lots of positive cash flow for USCIS and immigration attorneys. So they must be generating this panic attack to make sure everyone file July first week or second week.

What a way to make some quick millions here :confused:

IS it possible to send to TSC even though 140 is approved in NSC. Looks like 80 percent of applications go to TSC. Can we even choose where we can send?

Could someone having experience with self EAD renewal, please provide, application form #, documents needed for EAD renewal, and fee. I would like to do it myself.

Small companies will do this. If it is a big company with HR and payroll departments not being micro managed by the employer - then you won't face these problems.

This question was asked yesterday and I answerd it on another thread. There are several such questions for which USCIS will have to issue a regulation to interpret the law when it passes.

Please do not start new threads for every comment these days. Its tough to manage threads and it gets confusing. lets stick to CIR discussion and action alert threads these days for any comment and discussions we may want to do on CIR.

Even though, i have everything ready, I will send my docs next week. No need to get into panic gear. If the dates retrogress, screw GC, if not well and good.
